The WA organic farmer who recently lost a court battle over compensation for the contamination by genetically modified canola grown by his neighbour, has filed a notice of appeal.

The farmer, Steve Marsh, said he lost the organic certification for more than half his property for almost three years, as a result of the contamination.

The landmark case was the first of its kind in the world, and made waves worldwide when the court ruled in favour of his neighbour after a three week trial in the WA Supreme Court.

Marsh is being represented pro bono by Slater & Gordon, and he waited until the final day given to to appeal the decision.

"After a lot of consideration, my wife Sue and I have decided to exercise our right," Marsh said.
