The Western Australian organic canola farmer who was appealing a court battle over compensation for the contamination by genetically modified (GM) canola grown by his neighbour, has lost the case.

The case was the first of its kind in the world, and it made news worldwide when the court ruled in favour of his neighbour after a three week trial in the WA Supreme Court.

The farmer, Steve Marsh, initiated legal proceedings against his neighbour Michael Baxter after losing the organic certification for more than half his property for almost three years in 2010, following the contamination.

Monsanto contributed to Baxter's court costs and Marsh's campaign was supported by the Safe Food Foundation, according to ABC Online.

Marsh is now reportedly considering a High Court appeal.
