A protracted legal battle involving Australian entrepreneur Dick Smith and yeast-spread brand AussieMite reached its conclusion last week with the Federal Court ruling Dick Smith’s OzEmite spread could stay on supermarket shelves.
Intellectual Property Australia initially ruled in favour of AussieMite in 2014 but both parties have been putting forward public defences for their brands since then.
On Friday, however, the final verdict was that OzEmite can remain on the trade marks register. The Federal Court judge also ordered AussieMite to pay Smith’s legal costs.
Profits from OzEmite go towards various Australian charities such as the Cancer Council and the McGrath Foundation, but Dick Smith told Smart Company the lengthy legal battle meant less money will be sent to these charities.
