Frucor, the maker of V energy drinks and the Coca-Cola Company are going head to head over the colour green.

 

The legal battle, which went to a case management hearing this week, is over ownership rights to a specific shade of green.

 

Frucor Beverages is taking on the Coca-Cola Company after it blocked its attempt to register the shade Pantone 376C, according to a Fairfax Media report.

 

Frucor Beverages reportedly applied to IP Australia in 2012 to stop other companies using the shade of green on other energy drinks, on the grounds that 48 per cent of survey respondents associated the colour with V.

 

However the Coca-Cola Company objected to the application, saying other soft drinks already used similar colours, including its own Mother energy drink, ‘Green Storm’ and Registrar of Trade Marks Michael Kirov rejected the application.

 

Last month, however, Frucor filed an appeal in a bid to overturn the decision, and the case is now before the court.
